1. Scope

These Terms of Service apply to the use of the platform Railwail ("Service"), operated by Philipp Schmid, Steinenberg 10, 88339 Bad Waldsee, Germany. By registering or using the Service, you agree to these terms.

2. Service Description

Railwail is an AI platform that provides access to various AI models (text, image, video, audio, speech, embeddings, code). The Service operates on a pay-per-use basis: you add balance and pay per model usage. Exact costs are displayed on each model page.

We do not guarantee constant availability or error-free generated content.

3. Account and Balance

An account is required to use the Service. You are responsible for the security of your credentials.

Balance is purchased via Stripe and credited to your account. Balance does not expire. Each time you use an AI model, the corresponding amount is deducted from your balance.

Refunds of unused balance are possible within 14 days of purchase. Contact us at info@railwail.com.

4. User Obligations

You may not use the Service for:

• Creating illegal, harmful, or offensive content
• Automated abuse of the platform without permission
• Violating third-party copyrights
• Generating deepfakes, misinformation, or content that harms individuals
• Circumventing security measures or rate limits

We reserve the right to suspend accounts for violations without prior notice.

5. Intellectual Property

AI-generated content: Content you generate through the Service belongs to you, to the extent legally possible. You are responsible for complying with applicable law when using this content.

Platform: Software, design, trademarks, and AI models remain the property of Railwail or the respective model providers.

6. API Usage

Access to the API is subject to these Terms of Service. API keys must be kept confidential. Abuse of the API (e.g., excessive requests, reselling access) may result in suspension.

7. Disclaimer of Liability

The Service is provided "as is." We make no warranties regarding:

• The accuracy, completeness, or suitability of AI-generated content
• Uninterrupted availability of the Service
• Damages arising from the use of the Service

Our liability is limited to the amount you have paid us in the last 12 months.

8. Privacy

Your data is processed in accordance with our Privacy Policy. We do not use your inputs to train AI models.

9. Changes

We may change these Terms of Service at any time. You will be notified by email of material changes. Continued use after changes constitutes acceptance.

10. Governing Law and Jurisdiction

German law applies. The place of jurisdiction is Bad Waldsee, Germany.
